The short version
- SiteProfit is a record-keeping tool. The figures are only as good as what you enter.
- It is not accounting, tax or legal advice.
- The subscription is bought, billed and cancelled through Apple.
- If you stop paying, your records are kept. You can still sign in to export or delete them.
1. These terms
These terms are an agreement between you and Elm Tree Digital, in Ireland. "We" and "us" mean Elm Tree Digital. SiteProfit is our iPhone app.
By creating an account or using SiteProfit, you agree to these terms. If you do not agree, please do not use the app.
2. Your account
- You must be 18 or over, and using SiteProfit for your business.
- Keep your sign-in details safe. You are responsible for what happens under your account.
- Tell us straight away if you think someone else has got into your account.
3. Subscription and payment
- SiteProfit is paid for by subscription. You buy it inside the app, and Apple takes the payment through your Apple ID.
- The price is shown in the app before you buy.
- If a free trial is offered, its length is shown in the app before you start. When the trial ends, the subscription starts and you are charged, unless you cancel at least 24 hours before the trial ends.
- Your subscription renews by itself at the end of each period, unless you cancel at least 24 hours before the period ends.
- To cancel, open your iPhone's Settings, tap your name, then Subscriptions. Deleting the app does not cancel your subscription.
- Refunds are handled by Apple, under Apple's rules. We cannot refund an Apple payment ourselves.
- If the price changes, Apple will tell you before the new price applies.
4. If you stop paying
Your records are kept. You can still sign in, manage your account, and export or delete your records.
5. What SiteProfit is, and what it is not
- SiteProfit is a record-keeping tool. It shows you figures worked out from what you enter.
- The figures depend on what is entered. If an entry is wrong or missing, the figures will be wrong.
- SiteProfit is not accounting, tax or legal advice, and it does not replace your accountant.
- Check with your accountant before you rely on any figure for a tax return or a big decision.
6. Your records
- What you enter is yours. You give us permission to store it and use it to run the service for you.
- How we handle personal data is set out in our privacy policy.
- You are responsible for having the right to enter details about other people, such as clients and staff.
- Keep your own copies of anything important. You can export your records from the app.
7. Fair use
Please do not:
- use SiteProfit to break the law
- try to break into the service, overload it, or get at anyone else's records
- share your account, resell the service, or copy the app
We can suspend or close an account that abuses the service. Where we can, we will tell you why.
8. Changes to the app
We work to keep SiteProfit running, but we cannot promise it will never be interrupted. We may add, change or remove features. If we ever stop the service, we will give you reasonable notice so you can export your records.
9. Our liability
- We provide SiteProfit with reasonable care, but we do not promise that it will be free of errors.
- As far as the law allows, we are not liable for loss of profit, loss of business, or indirect losses.
- As far as the law allows, we are not liable for losses caused by wrong or missing entries, or by decisions made using the figures.
- As far as the law allows, our total liability to you is limited to what you paid for SiteProfit in the 12 months before the claim.
- Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer.
10. Apple's terms
Apple's standard licence agreement for apps also applies to SiteProfit. You can read it at apple.com/legal/internet-services/itunes/dev/stdeula.
11. Law
These terms are governed by the law of Ireland. The Irish courts deal with any dispute.
12. Changes to these terms
When these terms change, we update this page and the date at the top. If the change is a big one, we will tell you in the app or by email. If you keep using SiteProfit after a change, you accept the new terms.
